Foundation setbacks and frost depth

Minimum property-line setbacks, frost depth requirements, and bearing conditions for residential foundations in North Carolina.

Setbacks are local, not state#

Residential setbacks are controlled by the local zoning ordinance, not the state residential code. The adopted zoning in your jurisdiction defines front, side, and rear setback distances and any additional setbacks from easements, rights-of-way, or environmental overlays.

Pull the parcel's zoning classification from the county GIS system before drawing anything. Then cross-reference the classification against the zoning table in the local unified development ordinance.

The state minimum footing depth is 12 inches below finished grade, but the local authority having jurisdiction may adopt a deeper value for colder parts of the state. Always confirm the adopted frost depth with the permit office before digging footings.

Footings must bear on undisturbed soil or compacted engineered fill. Organic material, topsoil, or disturbed soil is not acceptable bearing.

The default assumed soil bearing capacity for residential design is 1500 psf unless a soils report provides a different value. Footings must be sized so the applied load does not exceed the assumed bearing capacity.

If the site has a history of fill, expansive soils, or known settlement problems, a soils report from a licensed geotechnical engineer is required before designing the foundation.

Plot plan requirements#

The plot plan submitted with the permit must show property lines, the proposed structure footprint, required setback distances, existing easements, and the closest distance from any part of the foundation to each property line.

Decks, porches, and cantilevered features count toward setback measurements even if they do not share the main foundation.

Common inspection flags#

Frequent setback and foundation issues caught on plan check or first inspection:

  • Setback measured to the exterior sheathing face instead of the farthest projection
  • Footings placed at the 12-inch minimum when the local authority has adopted a deeper frost depth
  • Footings bearing on disturbed or organic fill
  • Plot plan missing a required easement line
  • Corner of the foundation encroaching on a side-yard setback by a few inches
