Terms of Use

These Terms of Use (“Terms”) govern your use of mcgillcodesigns.com (the “Site”) and the McGill client portal (the “Portal”), both operated by McGill & Co. Designs, a North Carolina business (“we,” “us,” or “our”). By accessing the Site or the Portal, you agree to these Terms.

These Terms cover website and portal use only. Terms governing the purchase of our design, rendering, or design-build services are on the Terms of Sale page. Information we collect is described in the Privacy Policy.

1. Eligibility

You must be at least 18 years old to submit an inquiry, create a Portal account, or enter into a Service Agreement with us. The Site is not directed to children under 13, and we do not knowingly collect personal information from children. See the Privacy Policy for detail.

2. Acceptable use

When you use the Site or Portal, you agree not to:

  • Use them for any unlawful, fraudulent, or abusive purpose;
  • Attempt to gain unauthorized access to any account, server, or network;
  • Interfere with, disrupt, or degrade the Site or Portal, including through denial-of-service, brute-force login attempts, or excessive automated requests;
  • Scrape, crawl, or harvest content except as permitted by our robots.txt file and applicable law;
  • Reverse engineer, decompile, or disassemble any software we deliver to you through the Site or Portal;
  • Upload viruses, malware, or content that infringes a third party’s rights;
  • Submit information you know to be false, misleading, or impersonating another person.

We may suspend or terminate access for any user who violates these rules or whose activity we reasonably believe poses a risk to the Site, the Portal, or our other users.

3. Accounts and security

The Portal is provided as a convenience for current and former clients. You are responsible for:

  • Maintaining the confidentiality of your Portal login credentials;
  • All activity that occurs under your account;
  • Keeping the email address and phone number on your account current;
  • Notifying us immediately at Dylan@McGillCoDesigns.com if you suspect unauthorized access.

We will not be liable for any loss that results from your failure to follow these security practices.

4. Inquiries and booking

You may contact us through the contact form, book a consultation through Microsoft Bookings, or reach us by email or phone. Your submission is used to evaluate fit and prepare a consultation. Submitting an inquiry or booking a call does not create a contract or obligate either party. Any pricing, timelines, or scopes discussed before a signed Service Agreement are preliminary and non-binding.

5. Intellectual property

All content on the Site — including text, photography, renderings, video, source code, logos, illustrations, and design systems — is owned by McGill & Co. Designs or our licensors and is protected by U.S. copyright and trademark law and international treaties.

You may view Site content for personal, non-commercial purposes. You may not reproduce, distribute, publicly display, modify, or create derivative works from Site content without our prior written permission. Ownership of deliverables produced for a client under a Service Agreement is addressed in the Terms of Sale and in the applicable Service Agreement.

6. User content and messages

The Portal lets you upload documents, images, messages, and other materials (“User Content”). You retain ownership of your User Content. By uploading User Content you grant us a limited, non-exclusive license to store, transmit, display, and process it for the purpose of delivering Services under your Service Agreement and operating the Portal.

You are solely responsible for ensuring that User Content does not infringe a third party’s rights or violate any law.

7. Third-party services

The Site and Portal integrate with third-party services including (without limitation) Supabase (database and authentication), Resend (transactional email), Stripe (payments), Microsoft Bookings (scheduling), reCAPTCHA (anti-abuse), Vercel (hosting), and zippopotam.us (ZIP code lookup). Use of those services is subject to the providers’ own terms and privacy practices. We are not responsible for the content, policies, or outages of third-party services. 8. AI-assisted features

Some features of the Site and Portal (including but not limited to draft proposal generation and the Code Guide assistant) use large-language models provided by Anthropic. Output from those features may contain inaccuracies. Always review AI-generated content before relying on it for a decision. Human review by us or by you is required on any AI output used in a Service Agreement or project decision.

9. Availability

We do not guarantee that the Site or Portal will be available at all times, uninterrupted, or error-free. We may schedule maintenance windows and may make changes to features, functionality, or content at any time without notice. Critical outages affecting project delivery are communicated through the Portal or by email when practical.

10. Disclaimers

THE SITE AND PORTAL ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Design ideas, portfolio imagery, and inspiration content on the Site are illustrative and are not a guarantee of any specific project outcome.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, McGILL & CO. DESIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PORTAL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR PORTAL IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).

Liability related to paid Services is governed by the Terms of Sale and the applicable Service Agreement, not this section.

12. Indemnification

You agree to indemnify and hold harmless McGill & Co. Designs, its owners, employees, and subcontractors from any claim arising out of your use of the Site or Portal in violation of these Terms or of applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Wake County, North Carolina.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page shows when the current version took effect. Continued use of the Site or Portal after an update constitutes acceptance of the updated Terms.
